Rules of Reece National Customer NRL Footy Tipping Competition 2012 
1.	In these Terms & Conditions of Entry, unless the contrary intention appears, the following words and phrases have the meanings set out opposite them:  
“Away Team” means the team that is listed by the Code as playing away from their home ground. 
"Code" means the Australian National Rugby League. 
“Competition” means the Reece National Customer Footy Tipping Competition 2012 in respect of the Code whereby winning entries are based on the Results of Matches at the conclusion of the Season.
“Customer” means any current Reece trading account holder or employee of account holder.
"Match" means a single game conducted by the Code, between member teams of the Code, in a Season; 
"Participant" means a person who is eligible to participate in the Competition and registers for or participates in the Competition. 
“Promoter” Reece Pty Ltd ACN 004097090
"Results" are the results of Matches as officially determined by the Code in accordance with the rules of the Code following the completion of a Round. 
"Round" means a round of the Code conducted during the Code's Season. 
“Season” means the series of ‘home and away’ Matches (as indicated otherwise on the Web Site) for the Code in 2012 but excludes any finals.
"Score" means the allocation of points to a Participant for the correct selection of a Match.
"Web Site" means the Web Site for the Competition accessible on the Internet through the World Wide Web. 
2.	Employees of the Promoter are not eligible to enter the Competition.
3.	The Competition opens at 07.00am Australian Eastern Daylight Saving Time (“AEDST”) on Thursday 01/03/2012 and will conclude at 11.00pm Sunday 09/09/2012. 
4.	To enter the Competition, a Participant must register on the Web Site. A Participant may only enter the Competition once.
5.	Entry to the Competition is Free.
6.	Competition Prize allocation is as follows:
1st prize - Participant who finishes with the highest Score of the Competition at the end of the Season
2nd prize - Participant who finishes with second highest Score of the Competition at the end of the Season
3rd prize - Participant who finishes with the third highest Score of the Competition at the end of the Season
4th prize - Participant who finishes with the fourth highest Score of the Competition at the end of the Season
5th prize - Participant who finishes with the fifth highest Score of the Competition at the end of the Season
7.	The Promoter, reserves the right not to accept registration from any Participant if the registration contains anything slanderous or defamatory or is otherwise unsightly in any way, as determined by the Promoter in its absolute discretion. Likewise, the Participant’s participation in the Competition can be withdrawn due to unsightly conduct during the course of the Competition, or after the Competition has ended but before the prizes have been awarded, at the Promoter’s absolute discretion.
8.	Participants will be allocated one (1) point towards their Score for each correct selection. (1) point is automatically allocated if the result of a match is a draw. There are no points awarded for an incorrect tip.
9.	Margin Rule: For each round a game is nominated (usually the first game of each round) to be the margin game. Each tipper must select the winning margin of the winning team that has been tipped. An accumulative total of each entrant’s margin score is recorded each week for the duration of the season. In the case of two entrants being tied on the same score at any stage of the season, position of ranking will be determined by the entrant with the lower accumulative total margin.
10.	A Participant may make or change a tip for a given Match in a Round at any time prior to the scheduled starting time of that Match. 
11.	If a Participant: 
a)	does not submit a tip for a given Match in a Round, then the Participant's tip for that Match will be deemed to be for the Away Team. 
b)	does not submit any tips into the Competition for a given Round, the Participant's tips for that Round will be deemed to be for the Away Teams.
c)	enters the Competition after the commencement of the first Round, then the Participant’s tips for those Rounds that have been completed will deemed as 0 for each round prior to entry.
12.	In order to determine the results in each Round, Participants will be ranked:
a)	firstly by their Score, where the highest Score has the highest rank;
b)	then, in the case of a tie, by each Participant’s score being the same, Participants will be ranked by the Margin Rule (rule 9).  In the case of a further tie, Participants will be ranked by who entered into the Competition first.
The weekly rankings for a given Round will be determined no later than 72 hours after the last Match of the particular Round has ended. 
13.	The ranking of end of Season place winners will be determined:
a)	firstly, by the Participant’s total Score for all Rounds, where the highest Score has the highest rank; 
b)	then, in the case of a tie, by each Participant’s score being the same, Participants will be ranked by the Margin Rule (rule 9). In the case of a further tie, Participants will be ranked by who entered into the Competition first.
The end of Season rankings will be determined no later than 72 hours after the final Round of the Season has been completed.
14.	In the event of a Match in a given Round being cancelled, abandoned, not completed or not played for any reason and the Code does not official declare a Result within 3 days of the date of the Match was originally scheduled to be played, it is treated as a win for both teams competing in the Match. 
15.	All prize winners will be notified in writing within 2 days of the conclusion of the Season. The Promoter will within one month after the end of the Season deliver the prizes to the prize winners. 
16.	All prize winners’ names will be published in The Herald Newspaper on 16 September 2012. All Participants consent to their names being published in The Herald Newspaper.
17.	Any cost associated with accessing the Web Site is the Participant’s responsibility and is dependent on the Internet service provider used. A Participant electing to access the Web Site via wireless platforms for the purpose of registering for a Competition and/or entering tips may be subject to content service fees imposed by its telecommunications provider. No revenue sharing or commission arrangement exists between the Promoter and the telecommunications provider in relation to any such transactions.
18.	The Promoter reserves the right, at any time, to verify the validity of registrations and tips and the eligibility of applicants and Participants (including an applicant’s or Participant’s identity, age and place of residence, or whether or not they constitute a Customer) and to disqualify any Participant who submits a registration or tip that is not in accordance with these Terms and Conditions of Entry or who tampers with the registration or tipping processes. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
19.	Except for any liability that cannot be excluded by law, the Promoter and its agencies associated with this Competition (including their respective officers, employees and agents) are not liable and do not accept responsibility for: 
a)	a Participant's tips that are not received or which are received and subsequently corrupted or rejected by the Web Site, whether or not after receipt by the Promoter; 
b)	any lost, misdirected or corrupt emails to or from the Web Site; 
c)	any loss or damage whatsoever (including but not limited to direct, indirect or consequential loss) or personal injury suffered or sustained: 
(i)	in connection with a Participant’s participation in the Competition or the taking of a place or prize; or
(ii)	otherwise relating to the conduct of the Competition however caused, including but not limited to failure of the Web Site service or incorrect or corrupt data supplied by the Promoter to a Participant. 
d)	any theft, unauthorised access or third party interference;
e)	any variation in the value of any prize; or
f)	any tax liability incurred by a Participant or prize winner.
20.	Information about Participants is used by the Promoter to assess and process registration in the Competition. If an applicant does not provide the required information, the Promoter cannot process the registration. All entries become the property of the Promoter and will be entered into a database. Information emanating from the Participant's participation in the Competition is used by the Promoter and its contractors associated with this Competition, including but not limited to ExtraCorp Pty Ltd ABN 40 091 402 327 (“ExtraCorp”), for the determination of winners and distribution of prizes, if any, awarded to a Participant. Participants consent to publishing their name and Score in the results section of the Web Site and as otherwise set out in these Terms and Condition of Entry. The Promoter will not be held responsible for any loss of reputation, status or otherwise in connection with a Participant's tipping selections and consequential results. It is a condition of entry that Participants consent to these uses and disclosures of their information. 
21.	Unless you have marked the “opt-out” box upon entering the Competition you also agree to the Promoter storing and using your personal information for marketing purposes, including contacting you by electronic messaging. 22.	Notwithstanding the Promoter's rights under these terms to not accept or to subsequently disqualify a Participant, the Promoter will not be liable for any legal action arising out of any Participant’s name or postings on the Web Site being slanderous, defamatory or unsightly to the public at large, except for any liability that cannot be excluded by law. By participating in the Competition, each Participant agrees to indemnify the Promoter, its agents, contractors and related companies from any legal action, claim or dispute arising in relation thereto. 
23.	In the event there is a dispute concerning the conduct of the Competition, the decision of the Promoter is final and no correspondence will be entered into. 
24.	Prizes are not transferable or exchangeable without the consent of the Promoter and cannot be taken as cash. If the Promoter is unable to provide any winner with a nominated prize, the Promoter reserves the right to supply an alternative prize of similar monetary value subject to the laws of New Zealand. The Promoter accepts no responsibility for any variation in prize values. 
25.	A Participant cannot transfer their rights under these rules to any third party.
26.	By entering into the Competition, the Participant agrees and acknowledges that if they win a prize:
a.	the Participant may be contacted by the Promoter to provide comments about the Competition and the Promoter (or an agent of the Promoter) may take photos of the winner;
b.	the Promoter may use such comments or photos (the "Materials") for the Promoter's future promotional and marketing purposes without further reference or compensation to the Participant;
c.	the Promoter may duplicate, alter, adapt and utilise the Materials as the Promoter wishes at anytime, anywhere, and by any means.  The Promoter may license, authorise or otherwise transfer the rights in the Materials to others to do the same;
d.	the Participant acknowledges that, by entering the Competition, the Participant grants to the Promoter on creation of the Materials  a royalty free, perpetual, exclusive and irrevocable licence to use the Materials for whatever purpose;
e.	the Participant unconditionally and irrevocably consents to any act or omission that would otherwise infringe any of the Participant's moral rights in the Materials (as defined in Part IV of the Copyright Act 1994) and present and future rights of a similar nature conferred by statute anywhere in the world whether occurring before or after this consent is given ("Moral Rights");
f.	the Participant waives all Moral Rights in the Materials that arise outside New Zealand; and
g.	the Participant agrees not to institute, maintain or support any claim or proceeding for infringement of the Participant's Moral Rights in the Materials.
27.	The Promoter shall not be liable for any manufacturer defects in prizes or for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of taking a prize, except for any liability which cannot be excluded by law.
28.	The Promoter is Reece Pty Ltd (ABN A.B.N. 84 004 097 090) of 118 Burwood Highway, Burwood, 3125.
